Under the order from Hennepin County District Court, United Credit must stop creating, using or reselling the manufactured affidavits, identify all the other debt-buying companies that it sold the affidavits to, and use its best efforts to retrieve them.
United Credit was sued last month by Minnesota Attorney General Lori Swanson, who accused the firm of using the fake legal documents, complete with cut-and-paste bank logos. The affidavits falsely appeared to have been signed by officers of the original banks and notarized,
The overdraft fees originally were owed by account holders to banks that included Wells Fargo, U.S. Bank, Bank of America, Fifth Third Bank and Huntington National Bank.
